Thank you for choosing Show Me Partners Inc, trading as Fire Pit Suites, (“we”, “us”, or “our”) to help you purchase luxe firesuite tickets (collectively, the “Tickets”). We hope you enjoy your experience with us. By using Fire Pit Suites website (the “Website”) to purchase Tickets or using any of Fire Pit Suites’ services (the “Order”), you agree to these terms and conditions, which include Privacy Policy (collectively, the “Agreement”). 1. Using the Website
Our Website helps you find Tickets posted for sale by the ticket seller, their representative, or facilitator (collectively, the “Owner”). The Website shows details such as the event, date, location, price in U.S. Dollars (which may be higher than the face value), and any other relevant information regarding the details of the tickets (the “Listing”). Please note that photographs on the Website are for illustration only and may not accurately reflect the actual suite or seating.
2. Purchasing Tickets
Tickets on our Website are available for purchase immediately, unless otherwise stated. Listings without tickets will have a Wait List option.
By purchasing Tickets, you agree to purchase them as described. Payments for Tickets can be made using a credit card directly on the Website. Orders will not be confirmed until payment is successfully processed.
If there are no Listings on the Website for an event, you can join our Waitlist. By joining the Waitlist, you are opting in to receive notifications via email from Fire Pit Suites should a Listing for that event become available. Joining the Waitlist does not obligate you to purchase.
3. Ticket Delivery
Fire Pit Suites will send your Tickets electronically to the email address you provided at the time of order. Ensure you check your inbox and spam/junk folders for Fire Pit Suites communications.
While Fire Pit Suites and its Sellers strive to deliver tickets as early as possible, in certain cases Sellers may have until 8:00 p.m. Eastern Time on the day before the event to provide valid tickets. Buyers acknowledge and agree that receipt of tickets by this deadline constitutes timely delivery under this Agreement.
Once Tickets are sent, Fire Pit Suites is not responsible for non-receipt due to any reason. Failure to accept the tickets does not constitute grounds for a refund or cancellation of your order. Proof of transfer information is kept to show the delivery of goods per the terms of sale.
4. Relationship with Fire Pit Suites
Fire Pit Suites is the seller of the Tickets. We do not endorse or represent the venue, event organizers, or any related parties. We are not liable for the event or venue conditions.
5. Your Responsibilities
You acknowledge that Fire Pit Suites has no control over the actions, conduct, or behavior of other event attendees, nor over conditions managed by the venue or event organizers, including but not limited to stage configuration, lighting, sound, weather, or sightlines. Such circumstances shall not constitute grounds for refunds, exchanges, or credits.
- Ensure all information you provide is accurate and up to date.
- Confirm that entering this Agreement does not conflict with any other agreements by which you are bound.
- Safeguard your Tickets once delivered.
- Access to the suite is limited to you and your guests as specified in the Listing.
- Follow all laws and venue rules.
- Be responsible for your guest’s behavior and any damages they cause.
- Cover the cost of any additional amenities not included in the Listing.
- Do not use the suite or Tickets for public promotions.
- Provide additional verification information if requested by Fire Pit Suites.
- Acknowledge that all payments are final with no refunds or exchanges unless specified.
- Agree not to resell the Tickets without Fire Pit Suites’ prior written consent. Resales must be relisted directly with Fire Pit Suites unless Fire Pit Suites gives consent to sell elsewhere.
6. Website Errors and Changes
Fire Pit Suites may modify or discontinue the Website at any time. We are not liable for errors on the Website or changes in Ticket prices or information. We reserve the right to cancel sales due to errors and issue refunds. No additional compensation can be claimed.
7. Postponed or Rescheduled Events
If an event is postponed or rescheduled, your Tickets will remain valid for the new date. Refunds will not be issued for such changes. Filing a chargeback for these reasons will result in Fire Pit Suites flagging your information with fraud management partners.
8. Canceled Events
Refunds are not provided for cancellations due to terrorism, violence, or acts of God. If an event is canceled and not rescheduled, you will receive a full refund within 14 days. Refunds are limited to the amount paid for the Tickets.
9. Limitation of Liability and Indemnification
Fire Pit Suites, the Owner, and the venue are not liable for damages or losses, including lost profits. You agree to indemnify Fire Pit Suites, its officers, agents, employees, directors, and suppliers from any claims related to this Agreement, your Ticket purchase, or event attendance.
Fire Pit Suites shall not be liable for, and expressly disclaims responsibility for, any dissatisfaction, inconvenience, or damages arising from factors beyond its control, including without limitation: the behavior of other patrons; decisions by event organizers or venues regarding production, staging, or configuration; or other conditions that may affect your event experience or view. By purchasing Tickets, you assume these risks inherent to live events.
10. General Provisions
- Notice: Send notices to Fire Pit Suites via email at support@firepitsuites.com.
- Waiver and Remedies: A delay in enforcing rights does not waive them. Remedies are in addition to other legal remedies.
- Severability: If any part of this Agreement is unenforceable, the rest remains effective.
- Binding Effect: This Agreement binds all parties and cannot be assigned without written consent. Fire Pit Suites may assign rights as needed.
- Governing Law: Texas law governs this Agreement. Arbitration will be governed by the Federal Arbitration Act.
- Arbitration: Disputes will be resolved through arbitration in Texas. The prevailing party may recover reasonable legal fees.
- Service of Process: Service of process may be done by certified mail or as allowed by law.
- Injunctive Relief: Non-breaching parties may seek injunctive relief.
- Entire Agreement: This Agreement supersedes all prior agreements. Changes must be in writing.
- No Interpretation Against Drafter: No interpretation rules will be applied against the drafter.
- Headings: Headings are for convenience and do not affect the Agreement’s terms.
